Health Care Fraud Schemes: Laboratory
Medical Laboratory Testing: Regulatory Changes and New Tools for Investigators
On May 6, 2024, the U.S. Food & Drug Administration (FDA) released its final rule on laboratory developed tests (LDTs), which has brought in new requirements for medical testing laboratories, and new tools for investigators. The FDA’s rule clarifies that LDTs fall within the definition of a device under the Federal Food, Drug, and Cosmetic Act with most being subject to premarket review and compliance requirements.
While the new regulations have already begun taking effect, strong objections from some members of Congress and pending legal action from the lab industry make the ultimate fate of the new FDA rule uncertain. If the FDA rule survives current challenges, its impact will be many years in the making with incremental changes over time.
This webinar will focus on the concerns that prompted the FDA to pursue the rule change, what changes the rule brings, how it relates to CLIA (ie. the Clinical Laboratory Improvement Amendments of 1988), and connections to state level biomarker legislation. The information presented will help SIU personnel understand the nuances of these changes and how to prepare for analytics and investigations of future lab claims.
